Xperio Terms of Service
1. Introduction
Purpose: Xperio is a peer-to-peer online platform that connects travelers seeking unique, localized experiences with hosts offering them. By accessing or using Xperio's services, both hosts and travelers agree to these Terms of Service.
Scope: These terms govern your use of the platform, including but not limited to booking experiences, communicating with hosts/travelers, and participating in hosted activities.
2. Definitions
"Host": An individual or group who lists, offers, or provides an experience on the Xperio platform.
"Traveler": A person who books or participates in an experience provided by a host.
"Experience": Any service, activity, or event offered by hosts on Xperio.
"Platform": The Xperio website, mobile app, and other digital services.
3. User Eligibility
Age: You must be at least 18 years old to use Xperio services, or the legal age in your jurisdiction.
Account Setup: To access certain features, users must create an account, provide accurate information, and maintain the security of their account.
4. Responsibilities of Users
Travelers:
- Booking and Payment: Travelers must make full payment for any experience through the platform and are bound by the host's cancellation policies.
- Behavior During Experience: Travelers must respect the local culture, customs, and any rules set by the host. Any illegal or inappropriate behavior may result in termination of the experience and expulsion from the platform.
- Risk Acknowledgment: Travelers acknowledge the potential risks inherent in certain experiences (e.g., adventure activities, wildlife experiences) and agree that Xperio is not liable for any injuries or damages that occur during an experience.
Hosts:
- Accuracy of Listings: Hosts must ensure that all experience listings are accurate, clear, and truthful, including any risks or special conditions that may apply.
- Compliance with Local Laws: Hosts are responsible for complying with all applicable laws, rules, and regulations regarding their offered experiences.
- Safety and Well-being: Hosts are responsible for ensuring the safety and well-being of travelers during the experience, including providing necessary safety equipment and instructions where relevant.
5. Xperio as an Intermediary
Platform Role: Xperio acts solely as an intermediary to connect travelers with hosts. The platform does not control, operate, or supervise any experience and is not responsible for the actions of either party.
Liability Limitation: Xperio is not liable for any loss, injury, or damage incurred during the experience, including but not limited to physical injuries, property damage, or emotional distress.
6. Booking and Payment Policies
Payment Terms: Travelers must pay the full experience fee at the time of booking. Xperio processes payments on behalf of the host and takes a service fee.
Host Payouts: Hosts will receive payment after the successful completion of the experience, minus the platform's commission.
Refunds and Cancellations: Travelers may cancel a booking subject to the host's cancellation policy. Any refunds will be processed based on the timeline outlined by the host's policy. Xperio will not be liable for cancellations by hosts or travelers.
7. Insurance and Safety
Host Liability: Hosts are strongly encouraged to obtain insurance that covers their liability for hosting experiences. Xperio does not provide insurance for hosts or travelers.
Traveler Responsibility: Travelers are responsible for obtaining their own travel or medical insurance to cover any unforeseen circumstances during their participation in an experience.
Safety Measures: Both travelers and hosts must adhere to all safety guidelines and protocols during the experience. Hosts must disclose any risks or hazards involved in the experience and ensure proper safety precautions are taken.
8. Reviews and Ratings
Mutual Reviews: After completing an experience, both hosts and travelers can leave reviews. These reviews must be honest and free from defamatory or offensive content. Xperio reserves the right to remove any inappropriate reviews.
Impact on Future Participation: Reviews help maintain trust on the platform. Poor reviews may affect the host or traveler's ability to participate in future bookings.
9. Dispute Resolution and Arbitration
Disputes between Users: Any disputes between hosts and travelers should first be attempted to resolve amicably through the platform's messaging or support system.
Arbitration Clause: In case of unresolved disputes, users agree to submit to binding arbitration, waiving the right to a court trial. This applies to all claims arising out of or relating to these Terms or the use of the platform.
10. Intellectual Property Rights
Ownership: Xperio owns all rights to the platform and its services. Users are granted a limited, non-exclusive license to use the platform for the purpose of participating in experiences.
User Content: Any content submitted by users (e.g., reviews, photos) may be used by Xperio for promotional purposes.
11. Termination
By Xperio: Xperio reserves the right to suspend or terminate the accounts of users who violate these Terms or engage in inappropriate behavior.
By Users: Users may delete their account at any time, but certain obligations (e.g., ongoing bookings) must be honored before account closure.
12. Data Privacy
Collection of Personal Data: Xperio collects personal data in accordance with its Privacy Policy. By using the platform, users agree to the collection and use of their data as outlined.
Third-Party Sharing: Personal data may be shared with third parties only when necessary to facilitate the booking or experience.
13. Modifications to the Terms
Xperio may modify these Terms from time to time. Users will be notified of any major changes and continued use of the platform will constitute acceptance of the updated Terms.
